Article 2 — Scope

These General Terms and Conditions of Sale (GTC) apply to all distance sales concluded via the website bentixrobotics.com between BentiX and any buyer (professional or consumer). They take precedence over any other document from the buyer.

By placing an order, the buyer acknowledges having read and unconditionally accepted these GTC.

Article 3 — Products

The products offered for sale are described as accurately as possible (technical specifications, dimensions, weight, battery life, depth rating). BentiX reserves the right to modify its products without notice as part of its continuous improvement process.

Photographs and visuals are provided for illustrative purposes only. The characteristic orange colour of BentiX products may vary slightly depending on lighting conditions and screen settings.

Article 4 — Pricing

Prices are expressed in euros ($). BentiX operates under the VAT exemption scheme applicable to sole traders — prices displayed are inclusive of all taxes in accordance with applicable regulations.

BentiX reserves the right to modify its prices at any time. The applicable price is the one displayed at the time the order is confirmed.

Article 5 — Orders

An order is confirmed after:

  1. Product selection and cart validation
  2. Entry of delivery and billing information
  3. Selection of delivery method
  4. Payment validation
  5. Receipt of a confirmation email

BentiX reserves the right to refuse or cancel any order in the event of a payment issue, product unavailability or suspected fraud.

Article 6 — Payment

Payment is due at the time of ordering. Accepted payment methods are indicated at checkout (credit/debit cards, etc.), processed securely via Shopify Payments (PCI DSS certified). BentiX does not store any banking data.

Article 7 — Delivery

Delivery terms are detailed in our Shipping Policy. Risk transfers to the buyer upon handover of the parcel to the carrier.

Article 8 — Retention of Title

BentiX retains full ownership of the products sold until full payment has been received. All risk of loss or damage transfers to the buyer upon delivery.

Article 9 — Right of Withdrawal (consumers)

In accordance with applicable EU consumer protection legislation, any consumer has 14 days from receipt of the product to exercise their right of withdrawal, without having to provide any justification. See our Return Policy for the detailed procedure.

The right of withdrawal does not apply to orders placed by professionals in the course of their business activity.

Article 10 — Legal Warranties

Every consumer is entitled by law to the following warranties:

Legal conformity warranty: BentiX is required to deliver a product conforming to the contract. In the event of a conformity defect identified within 2 years of delivery, the buyer may choose between repair and replacement of the product.

Warranty against hidden defects: In the event of a hidden defect rendering the product unfit for its intended use, the buyer may choose between a full refund and a price reduction.

BentiX commercial warranty: 1 year — see Return Policy.

Article 11 — Liability

BentiX shall not be held liable for failure to perform the contract in the event of force majeure (natural disaster, pandemic, carrier strike, etc.).

The BentiX drone must be used in accordance with the documentation provided. BentiX accepts no liability for improper use, including:

  • Exceeding the certified maximum depth (98.43 ft)
  • Use outside the specified temperature range (0°C–40°C)
  • Failure to rinse with fresh water after use in salt water
  • Non-compliance with shutdown and storage procedures

Article 12 — Personal Data

The processing of personal data is governed by our Privacy Policy, compliant with the GDPR.

Article 13 — Mediation and Disputes

In the event of a dispute, the buyer is invited to contact BentiX at contact@bentixrobotics.com to seek an amicable resolution.

Failing an amicable resolution, consumers may have free recourse to an approved consumer mediator (list available at www.economie.gouv.fr).

For disputes not resolved through mediation, French courts shall have sole jurisdiction. French law is applicable.

Article 14 — Applicable Law

These GTC are governed by French law. Any dispute relating to their interpretation or performance shall be submitted to the competent French courts.
